The Value of Court-Appointed Neutrals in Tech Lawsuits

MMM Partner Larry Kunin recently wrote an expert opinion for Law.com’s Daily Report regarding the benefits of utilizing a court-appointed neutral in technology lawsuits. Kunin explains that Federal Rule 53 provides the legal framework to use a court-appointed neutral and that parties involved in technology disputes should consider utilizing them.

“Although court-appointed neutrals do not override the decision of the judge, they can more efficiently cut through the issues and educate the parties and the judge,” says Kunin, who serves as Chair of MMM’s Technology and Intellectual Property Litigation Practice.  

“The use of a court-appointed neutral gives the parties the right to have their cases assisted by a specialist as opposed to relying solely on a judge who may not be familiar with what may otherwise be seen as ordinary technology processes.”
