In a win for MMM’s client, the Atlanta BeltLine, and the City of Atlanta, the Supreme Court of Georgia has declined to hear a case against them brought on by an Atlanta condominium association. The association claimed that BeltLine developers, as well as the city of Atlanta, failed to compensate property owners for land used to create recreational trails.
The Supreme Court of Georgia did not cite a reason for declining the case.
In a Law360 article covering the case, MMM Partner Robert P. Alpert said that the BeltLine will “defend itself vigorously” in any future litigation. "We think that the Atlanta BeltLine is a great asset to the city of Atlanta and the state of Georgia, and that it's a very successful project that the citizens of Atlanta and Georgia will benefit from. With respect to the underlying claims asserted in the litigation, we don't think they have merit, and we think our client will prevail on those claims." Read more on the case in Law360 here.
