MMM represented Selective Way Insurance Co. in an insurance coverage matter arising out of a liquid nitrogen leak in 2021 at a Georgia chicken processing plant which resulted in the deaths of six plant workers. The insured, Foundation Food Group Inc., made claims for significant property loss, business income, and extra expenses in connection with the leak and resulting overflow of the liquid nitrogen. The insured dropped its $2 million nonpayment case after it was trimmed by a federal judge to a single contract breach claim. The case against Selective was dismissed with prejudice.
