Breaking News: CTA Enforcement Back on Pause

On December 26, 2024, the Fifth Circuit Court of Appeals vacated its December 23, 2024, order granting the government's motion to stay the district court's preliminary injunction enjoining the Corporate Transparency Act’s (CTA) enforcement. This decision temporarily halts enforcement of the CTA while the expedited merits appeal is underway.

The Fifth Circuit explained its decision to vacate the prior order was made “in order to preserve the constitutional status quo while the merits panel considers the parties’ weighty substantive arguments.”
