A case for fair and ethical AI?

01.17.2023

A class action lawsuit has been filed on behalf of artists and content creators alleging that various Artificial Intelligence (AI) companies have violated copyright laws by building AI art generators using millions of creators' IP rights without permission. It's alleged that the offending companies are scraping images from websites and platforms to inform their AI tool to create artwork, and that the resulting AI art infringes the IP rights of the original creator. The plaintiffs argue that these companies are appropriating the work of artists without consent, credit, or compensation. I'm certain these companies will in turn argue that this process is no different from an artist gathering inspiration from influential art. An interesting case to keep an eye on!

"AI needs to be fair and ethical for everyone," said lawyer/programmer Matthew Butterick. "But Stability AI, Midjourney, and DeviantArt are appropriating the work of thousands of artists with no consent, no credit, and no compensation. As a lawyer who is also a longtime member of the visual-arts community, it's a pleasure to stand up on behalf of fellow artists and continue this essential conversation about how we the people want AI to coexist with human culture and creativity."
