ABA Real Property, Trust & Real Estate Law Section Virtual CLE: Negotiating Legal Opinions

Doug Selph was a featured speaker at the Real Property, Trust & Real Estate Law Section Virtual CLE Conference, hosted by the American Bar Association on Wednesday, February 12. He joined Antonios Roustopoulos of Richards Layton & Finger and Anne-Thérèse Béchamps of Venable for a panel discussion on negotiating legal opinions. Their discussion focused on the negotiation of a standard real estate finance opinion from the perspectives of the lender’s counsel, borrower’s counsel, and local counsel in a hypothetical deal. The session delved into the key components of an opinion letter, including assumptions, qualifications, and opinions, as well as the strategies for drafting, reviewing, and addressing requests from various viewpoints.

Doug just completed a three-year term as Chair of the Attorney Opinion Letters Committee of the American College of Real Estate Lawyers (ACREL). ACREL is the preeminent association of commercial real estate lawyers in the U.S.
